Terms of Service

Effective Date: March 20, 2026

These Terms of Service ("Terms") govern your use of the RealtorAI platform and services operated by Good Creator LLC ("RealtorAI," "we," "us," or "our"). By subscribing to or using RealtorAI, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, subscribing to our service, or otherwise using RealtorAI, you confirm that you are at least 18 years old and have the legal authority to enter into these Terms. If you are using RealtorAI on behalf of a business or brokerage, you represent that you have the authority to bind that entity to these Terms.

2. Service Description

RealtorAI is an AI-powered marketing platform for real estate professionals. The service includes:

• Autonomous AI agent that researches, creates, and publishes social media content (Instagram Reels, Stories, posts, and Facebook cross-posts).
• Self-learning loop that analyzes engagement data and improves content strategy over time.
• AI voice cloning for Reel voiceovers using your voice recordings.
• Integration with 11+ real estate data sources (MLS, Redfin, mortgage rates, census data, competitor analysis, etc.).
• Content approval workflow via Telegram bot and web admin dashboard.
• Fair Housing compliance checks on all generated content.
• Personalized onboarding and configuration.

We reserve the right to modify, suspend, or discontinue any feature of the service at any time with reasonable notice.

3. Account Terms

• You must provide accurate and complete information during onboarding.
• You are responsible for maintaining the security of your Instagram, Facebook, and Telegram account credentials.
• You are responsible for all activity conducted through your RealtorAI account and connected social media accounts.
• One subscription per business entity or individual agent.
• We reserve the right to suspend or terminate your account for violation of these Terms or abusive conduct.

4. Subscription & Payment Terms

Pricing

• Subscription: $99 per month, billed monthly.
• API costs: Third-party API costs (typically $10-30/month) are billed separately at cost. You control your API budget ceiling through your dashboard.

Billing

• Payments are processed through Stripe. The subscription renews automatically each month.
• The charge amount is the price shown at the time of subscription.
• We may change pricing with 30 days' prior notice. Continued use after a price change constitutes acceptance.

Cancellation & Refunds

• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
• No refunds are provided for partial months.
• Upon cancellation, your AI agent stops publishing. Your data is retained for 30 days, after which it is permanently deleted unless you request earlier deletion.

EU/EEA Right of Withdrawal

Under the EU Consumer Rights Directive, you have a 14-day right of withdrawal from the date of subscription. To exercise this right, contact us at goodcreatorllc@gmail.com within 14 days. If you have actively used the service during this period, a pro-rated amount may be retained for services already rendered.

5. AI-Generated Content

• RealtorAI generates social media content using artificial intelligence. AI outputs are not guaranteed for quality, accuracy, virality, or engagement results.
• All generated content passes through Fair Housing compliance checks. However, you remain ultimately responsible for content published on your social media accounts.
• You should review and approve content before publication. The approval workflow (Telegram bot and admin dashboard) is provided for this purpose.
• We are not responsible for any consequences arising from content published to your social media accounts, including but not limited to regulatory violations, reputational harm, or lost business.

6. Intellectual Property

Your Content

• You retain ownership of all information, brand assets, voice recordings, and materials you provide during onboarding and ongoing use.
• You grant RealtorAI a non-exclusive, worldwide license to use, process, and store your materials solely for the purpose of providing the service.
• This license terminates upon account deletion or service cancellation.

Generated Content

• You receive a non-exclusive, perpetual license to use all AI-generated content (captions, images, videos, voiceovers) created by your RealtorAI agent for any purpose, including commercial use on your social media accounts and marketing materials.

RealtorAI Platform

• All platform design, code, algorithms, branding, documentation, and technology are owned by Good Creator LLC.
• You may not copy, modify, distribute, reverse-engineer, or create derivative works of the platform.

7. Acceptable Use

You agree not to:

• Use RealtorAI to generate content that violates Fair Housing laws, contains discriminatory language, or targets protected classes.
• Provide false or misleading property information for content generation.
• Use the service to harass, spam, or engage in deceptive marketing practices.
• Circumvent usage limits, budget controls, or security measures.
• Use automated tools, bots, or scripts to interact with the platform beyond normal usage.
• Share your account credentials or approval bot access with unauthorized individuals.
• Use the service for any unlawful purpose.

We reserve the right to suspend or terminate accounts that violate these terms without notice or refund.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Good Creator LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, business opportunities, reputation, data, or goodwill, arising from your use of the service.

Our total aggregate liability for any claims arising under these Terms shall not exceed the lesser of (a) the total amount you paid to us in the 12 months preceding the claim, or (b) $500 USD.

This limitation does not exclude or limit liability for fraud, death or personal injury caused by negligence, or any liability that cannot be excluded or limited under applicable law.

9. Disclaimer of Warranties

The RealtorAI service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The service will be uninterrupted, error-free, or secure.
• AI-generated content will achieve specific engagement, reach, or follower growth results.
• The self-learning loop will produce measurable improvements within any specific timeframe.
• Content will be free from all Fair Housing compliance issues (final review responsibility remains with you).
• Third-party APIs (Instagram, Facebook, Telegram) will remain available or function as expected.

10. Indemnification

You agree to indemnify, defend, and hold harmless Good Creator LLC, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising from:

• Your use of the RealtorAI service.
• Content published to your social media accounts through the service.
• Your violation of these Terms or applicable laws.
• Any third-party claims related to your real estate marketing activities.

This indemnification obligation does not apply where prohibited by law.

11. Dispute Resolution

Step 1: Informal Resolution

Before initiating formal proceedings, you agree to contact us at goodcreatorllc@gmail.com and attempt to resolve the dispute informally for at least 30 days.

Step 2: Binding Arbitration

If informal resolution fails, any dispute shall be resolved by binding arbitration administered by JAMS under its Streamlined Arbitration Rules. The arbitration shall take place in Sacramento, California, USA. The arbitrator's decision is final and binding.

Class Action Waiver

You agree to resolve disputes on an individual basis only. You waive any right to participate in class, consolidated, or representative actions or proceedings.

Exceptions

• Either party may seek injunctive or equitable relief in a court of competent jurisdiction.
• EU/EEA consumers may bring claims in their local courts as permitted by mandatory consumer protection law.
• This arbitration clause does not apply where prohibited by law.

12. Termination

• We may suspend or terminate your access at any time, with or without cause, with reasonable notice.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
• Upon termination, your AI agent stops operating immediately. Your data is retained for 30 days, then permanently deleted.
• Sections 6, 8, 9, 10, 11, and 14 survive termination.

13. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms on this page with a new Effective Date. For material changes, we will provide at least 30 days' notice via email. Continued use of RealtorAI after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, USA, without regard to conflict-of-law provisions. EU/EEA consumers retain the benefit of mandatory consumer protection provisions of their country of residence.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid while preserving its original intent.

16. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Good Creator LLC regarding the use of RealtorAI. They supersede all prior agreements, understandings, and communications, whether written or oral.

17. Force Majeure

We shall not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, internet outages, power failures, third-party API outages (Instagram, Facebook, Telegram), cyberattacks, or pandemic-related disruptions.
